Automated messaging and follow-up

Custom business communication workflows

CRM and client communication support

We reserve the right to modify or improve Services at any time.


2. ELIGIBILITY

By using our Services, you confirm that:

You are at least 18 years old

You are legally able to enter a binding agreement

You are using the Services for lawful business purposes


3. CLIENT ACCOUNT & RESPONSIBILITIES

Clients must:

Provide accurate business and contact information

Maintain the security of their login credentials

Notify us of any unauthorized account activity

Ensure all service usage complies with applicable laws

Provide accurate call scripts, instructions, and booking details

Clients are responsible for all activity that occurs under their accounts.


4. SERVICE FEES & BILLINs

4.1 Pricing

Service plans and pricing are listed on our website or agreed upon through a formal proposal.

4.2 Payment Terms

Fees are billed monthly unless otherwise stated

Payments are due immediately upon invoice

Failed or late payments may result in suspension of Services

All fees are non-refundable unless stated in writing

4.3 Taxes

Client is responsible for all applicable taxes.


5. CALL HANDLING & COMMUNICATION

By using our Services, you authorize Beyond Services to:

Answer, place, or route calls on your behalf

Capture caller information

Send or receive SMS messages

Book appointments into your calendar

Log all interactions in your CRM

We make reasonable efforts to follow your call instructions, but we do not guarantee outcomes such as:

Call conversions

Customer responses

Sales results


6. RECORDINGS & TRANSCRIPTS

Calls may be recorded or transcribed for:

Quality assurance

Internal training

Service improvement

Legal compliance

By using our Services, you acknowledge and authorize these recordings where legally permitted.


7. ACCEPTABLE USE POLICY

You agree NOT to use our Services to:

Conduct illegal activities

Send spam or unwanted communications

Abuse or harass callers

Violate privacy or data collection laws

Misrepresent your identity

Violation may result in immediate termination.


8. SERVICE AVAILABILITY

We aim to provide uninterrupted service but do not guarantee:

Zero downtime

Perfect transcription accuracy

100% error-free call handling

Third-party integration uptime (ex: phone carriers, CRM systems)

We are not liable for delays or failures caused by:

Internet providers

Phone carriers

Third-party platforms

Power outages or force majeure events


9. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Beyond Services is not liable for indirect, incidental, special, or consequential damages

Our total liability for any claim is limited to the amount paid by the client in the prior 30 days

We are not liable for lost profits, missed calls, booking errors, or integration failures caused by external platforms

10. TERMINATION

Either party may cancel Services at any time with written notice.

We may suspend or terminate Services immediately if:

Payments are overdue

Instructions violate laws

Abuse, fraud, or misuse is detected

Upon termination:

Fees already paid are non-refundable

Access to systems will be revoked


11. INTELLECTUAL PROPERTY

All content, branding, scripts, workflows, automations, and system configurations created by Beyond Services remain our intellectual property unless explicitly transferred in writing

Clients are granted a limited license to use the Services.


12. CHANGES TO TERMS

We may update these Terms at any time.

Changes take effect upon posting on our website.

Continued use of the Services signifies acceptance of updated Terms.


13. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any disputes shall be resolved in the courts located in San Diego County, California.
